TERMS AND CONDITIONS OF USE (TCU)
WHEELARCHERY and WheelArc Websites

Article 1 – Purpose
These Terms and Conditions of Use (hereinafter “TCU”) define the conditions for accessing and using the websites dedicated to the WHEELARCHERY sport, including the main website and the affiliated websites operated by the WHEELARCHERY France association (W59601136).
These websites aim to present the WHEELARCHERY sport, provide rules, recommendations and general information, and promote the activities of the WHEELARCHERY France association.
The websites do not in any way constitute a sports supervision, training, coaching, or monitoring service.

Article 1 bis – Affiliation of the Club France WheelArc Website
The “WheelArc” website, dedicated to Club France, is affiliated with the WHEELARCHERY France association and operates within the scope of its activities.
The WheelArc website is a variation of the main website and aims to present the activities, information, and initiatives of Club France under the WHEELARCHERY France association.
All content, information, rules, and communications published on the WheelArc website fall under the responsibility of the WHEELARCHERY France association under the same conditions defined in these TCU.
Use of the WheelArc website implies full acceptance of these TCU.

Article 2 – Acceptance of the TCU
Access to and use of the websites imply full, complete, and unconditional acceptance of these TCU. Any person who refuses these conditions must refrain from using the websites.

Article 3 – Nature of the Information Provided
The information provided is for informational purposes only. It does not constitute personalized advice, mandatory instructions, a safety guarantee, or authorization to practice. Users remain solely responsible for how they use the information made available.

Article 4 – Practice of the WHEELARCHERY Sport
4.1 Free and Unsupervised Practice
WHEELARCHERY is a free, voluntary, and unsupervised activity practiced under the sole responsibility of the participant. Neither the websites, the WHEELARCHERY France association, the creators of the sport, nor landowners or operators provide supervision, monitoring, or control.

4.2 Risk Activity
The practice may involve inherent risks, including bodily injury, falls, impacts, or property damage. Users acknowledge being aware of these risks and fully accept them.

Article 5 – User Responsibility
Each user declares that they are physically fit for sports practice, have personal liability insurance, and ideally individual accident insurance. Users practice at their own risk and remain solely responsible for their actions, equipment, behavior, and any persons accompanying them.

Article 6 – No Liability of the Association
The WHEELARCHERY France association disclaims all liability in the event of accidents, injuries, bodily harm, material damage, or any other prejudice occurring during the practice of WHEELARCHERY, regardless of location.

Article 7 – Responsibility of Grounds and Operators
Practice areas may belong to third parties or be operated by independent entities. Owners and operators, including EI DESCAMPS THIERRY, provide no supervision, safety, or sports management obligations and cannot be held responsible for user behavior, accidents resulting from misuse, failure to follow safety rules, or inappropriate practice.

Article 8 – General Exclusion of Liability
Within the limits permitted by law, the following are excluded from all liability: the WHEELARCHERY France association, its directors, members and volunteers, the creators of the sport, landowners and operators, and the website publishers. No claim, complaint, or legal action may be brought for facts resulting from the free practice of the sport.

Article 9 – User Conduct
Users agree to follow safety rules, adopt prudent and responsible behavior, not endanger others, and respect the regulations of the grounds used. Any dangerous, illegal, or inappropriate behavior engages the sole responsibility of its author.

Article 10 – Minors
Practice by minors occurs under the sole responsibility of parents or legal guardians. The websites do not verify age and disclaim all responsibility in case of unauthorized practice by a minor.

Article 11 – Access to the Websites
Access to the websites is free. The publisher reserves the right to suspend or modify all or part of the websites without notice or compensation.

Article 12 – Intellectual Property
The name WHEELARCHERY, content, texts, logos, rules, and concepts are protected by intellectual property law. Any reproduction or use without authorization is prohibited.

Article 13 – Personal Data
The websites may collect data strictly necessary for their operation. In accordance with the GDPR, each user has the right to access, rectify, and delete their data.

Article 14 – Modification of the TCU
These TCU may be modified at any time. The applicable version is the one published on the websites at the time of consultation.

Article 15 – Applicable Law and Jurisdiction
These TCU are governed by French law. Any dispute falls under the exclusive jurisdiction of the courts of the registered office of the WHEELARCHERY France association.

Article 16 – Image Rights and Data Protection (GDPR)
As part of the association’s activities, photographs and/or videos may be taken to promote the association’s actions (websites, social networks, communication materials). These images constitute personal data under the GDPR, used only within this framework and not transferred to third parties. Unless opposed, registration or participation implies free authorization to use the image for these purposes. Any person has the right to object, withdraw consent, and request deletion of images concerning them via the websites’ contact form. The association commits to processing the request promptly and stopping any future use.
